UF student tasered, Why? *Warning: Lots of "vulgar" language...Many apologies, I was a little pissed off upon making this video. "When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified." Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1. "These principles apply as well to an officer attempting to make an arrest, who abuses his authority and transcends the bounds thereof by the use of unnecessary force and violence, as they do to a private individual who unlawfully uses such force and violence." Jones v. State, 26 Tex. App. I; Beaverts v. State, 4 Tex. App. 1 75; Skidmore v. State, 43 Tex. 93, 903. "An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery." (State v. Robinson, 145 ME. 77, 72 ATL. 260).

2stankornot2stank Speech instead of question? C'mon! If Andrew was selling crack and fleeing arrest, or robbing a dorm, or raping a female student, then yeah, taser someone that is being arrested for a felony... but for talking and holding up a book? C'mon!

And its not about whether or not these questions are irrelevant or not, it's about freedom of speech people. I am royally pissed off at the incident. I am a university student and have attended many public forums and I have exercised my freedom of speech in front of the mike. This is ridiculous!

All the spin in the world can't deny the fact he was arrested for RAISING HIS VOICE and using emphatic gestures to make a point realizing that his questions were going to get stifled.... Please.

The cops started messign with him while he was asking the question at a Q & A, and they didn't want him to ask it, he had the right to ask it. Then when he wanted to keep asking they pulled him down, then for asking what was going on, they dog pile him, THEN taze him, which was completly uneccessary, I love cops as much as anyone else, but they started it.

Flailing one's arms and physically resisting police is violence according to the definition of the word. Neither were his hysterical "questions" and assertions relevant to the discussion. Suggest you watch the video's as what happened is very clear to the unbiased eye.

Eh...wrong. Anyone who takes the time to look up the legal definition knows what "disturbing the peace" means. I suggest you do that now before making such statements. The video is evidence and the law is unambiguous in this case. He disturbed the peace, resisted escort then arrest and went to jail. All the spin in the world can't change the facts or the law.

don't sweat these idiots. you're absolutely right. anyone notice the cops look at each other when he mentions "skull and bones"? look at their faces. it's obvious they don't want that question asked. better to have a big dog and pony show about civil rights then answer a question. this whole deal has been put out there to move the focus from the important issue to an issue of police brutality. the important issue is the question.
